The Website may contain hyperlinks to websites owned and operated by third parties, such as Kickstarter, Inc. These third party websites may have their own privacy policies and we recommend you to review them. They will govern the use of personal information you submit or which are collected by cookies whilst visiting these websites. We do not accept any responsibility or liability for the privacy practices of such third party websites and your use of them is at your own risk.

2. INFORMATION WE MAY COLLECT ABOUT YOU

Information provided by you when using the Website or e-shop

(“Submitted Information”)

You may give us information about you by filling in forms when using our services, as well as when creating your account during the registration process, or using the e-shop available on our Website.

Payment Information

In order for you to use the e-shop function on our Website we collect details of your billing address from you. All other payment details and information such as your bank account details will be collected by third party payment providers including Stripe and/or PayPal so that the processing, fulfilment and delivery of items that you have ordered from our e-shop can be delivered to you in a timely manner.

All financial transactions via our e-shop on the Website are handled through our payment services providers, who will have access to your payment information.   We do not share any personal information with third party payment providers including Stripe and/or PayPal, but you will be required to provide your information to them directly if you wish to purchase items from our e-shop.

We share your name, email address and billing address information with Xero for the purposes of generating sales invoices when you buy something via our e-shop. If we do share personal information with vendors (including Xero), they are only allowed to process it as necessary to perform the services we have requested.

 
Information about you collected from Third Parties (“Content Information”)

We may collect information about you from third party service providers (like social media companies, marketing partners or public databases) to use along with the information that we collect from you.

Other companies may set their own cookies or similar technologies when you visit the Website. This includes third parties that we have engaged to provide services on our behalf (like website analytics), as well as third parties that deliver content (like videos from YouTube).

3. WHY WE COLLECT INFORMATION ABOUT YOU

To provide the Website, our e-shop and Support Services to You

We will use information about you (including Submitted Information, Analytics, Payment Information and Content Information) for delivering our services to you, and to deliver any products that you purchase through our e-shop to you, under the terms of use agreed between us.

The particular ways we use personal information will depend on how you use the Website and e-shop. Examples of how we will use your personal information include:

  • responding to enquiries through our contact page or the Support Services;
  • to deliver and tailor our communications with you, including sending you announcements relating to matters requiring your attention (such as your account on the Website), or promotional communications that we believe may interest you;

We work with Parcelhub Ltd (“Parcelhub”) to help us fulfil your orders from our e-shop. In order to fulfil any orders that you make via our e-shop, and so that these can be delivered to you either electronically or by post, we may share the following personal information with Parcelhub:

  • Your phone number;
  • Your email address; and/or
  • Your postal address.

We also work with Studio 2 Publishing (“S2P”) to help us fulfil US orders from our e-shop. In order to fulfil any orders that you make via our e-shop, and so that these can be delivered to you either electronically or by post, we may share the following personal information with S2P:

  • Your phone number;
  • Your email address; and/or
  • Your postal address.
 
To Understand how our Website and e-shop are used

We process information (including Submitted Information, Analytics, Payment Information and Content Information) to understand how visitors use our Website and e-shop, and we may compile statistical reports regarding that activity under the terms of use agreed between us.

This processing is necessary for us to pursue our legitimate interest of (i) ensuring that our Website and e-shop function properly so that you and other users have the best experience when using them, and (ii) improving the quality of our Website and e-shop, and providing a better experience to our users.

We use various forms of marketing to provide you with promotional materials about our games and other products. We also use third-party analytics providers (including Google Analytics, WordPress Jetpack and Facebook Pixel) to help evaluate and report on your use of the Website.

We will not process your information for the purposes of marketing or pass your information on to third parties for the purposes of such marketing unless you give your consent or you have given it already.

Prevent Fraud and Illegal Activity

We process personal data for the legitimate interests of ensuring that use of the Website and e-shop (i) is lawful and non-fraudulent, (ii) does not disrupt the operation of our services, (iii) does not harass our staff or other individuals, and (iv) to enforce our legal rights and comply with our legal obligations.

Where we reasonably believe that you are or may be in breach of any of the applicable laws, we may use your personal information to inform relevant third parties such as your email/internet provider or law enforcement agencies about the content.

Personnel, Suppliers or Subcontractors: We keep your information confidential, but may disclose it to our personnel, suppliers or subcontractors insofar as it is reasonably necessary for the purposes set out in this privacy policy. However, this is on the basis that they do not make independent use of the information, and have agreed to safeguard this information.

Required by law: In addition, we may disclose your information to the extent that we are required to do so by law (which may include to government bodies and law enforcement agencies); in connection with any legal proceedings or prospective legal proceedings; and in order to establish, exercise or defend our legal rights (including providing information to others for the purposes of fraud prevention).

Merger or acquisition: If we are involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email, account message and/or a prominent notice on our website of any change in ownership or uses of this information, as well as any choices you may have regarding this information.

Enforcement: We may also disclosure your personal information to third parties in order to enforce or apply the terms of agreements, to investigate potential breaches, or to protect the rights, property or safety of Rowan, Rook & Decard, our customers or others.

5. CONSUMER CONTROL & OPT-OUT OPTIONS

If you do not wish to receive promotional or other marketing material from us or third parties then you can opt-out by contacting us via the Support Service and letting us know that you no longer wish to receive such promotional or other marketing material.

Additionally, while we offer you the option to receive updates and promotional communications from us, you can change your preferences at any time. To opt-out simply “unsubscribe” by following the instructions in any of our promotional emails. These choices do not apply to mandatory communications that are part of our services, like important account-related notices.

Ad companies, analytics providers and similar third parties place their own tracking technologies on the Website (please see “Information we may collect about you” above).   • you consented to us processing the personal data, and have withdrawn that consent;
  • we no longer need to process that personal data for the reason it was collected;
  • we are processing that personal data because it is in the public interest or it is in order to pursue a legitimate interest of Rowan, Rook and Decard, you don’t agree with that processing, and there is no overriding legitimate interest for us to continue processing it;
  • the personal data was unlawfully processed;
  • you need the personal data to be deleted in order to comply with a legal obligations;
  • the personal data is processed in relation to the offer of a service to a child.
 
Obtain a machine readable copy of your personal data, which you can use with another service provider
  • If we are processing data in order to perform our obligations to you, or because you consented, if that processing is carried out by automated means, we will help you to move, copy or transfer your personal data to other IT systems.
  • If you request, we will supply you with the relevant personal data in a machine-readable format. Where it is technically feasible, you can ask us to send this information directly to another IT system provider if you prefer.
 
Make a complaint to a Supervisory Authority
  • If you are unhappy with the way we are processing your personal data, please let us know via the Support Services.
  • If you do not agree with the way we have processed your data or responded to your concerns, an alternative is to submit a complaint to a Data Protection Supervisory Authority.

7. DATA RETENTION

  • If you do provide us with personal information we generally retain it for as long as your account on the Website is active, or as is otherwise necessary for us to provide the Website to you, or as otherwise described in this privacy policy.
  • If you want to stop receiving our newsletter you can contact us via the Support Service and ask to be removed from our mailing list, update your preferences or unsubscribe by following the unsubscribe-link that is in the newsletter itself.

8. CHILDREN

You should be at least 13 to use our Website and register an account on our Website. We do not use the Website to knowingly solicit data from or market to children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us via the Support Services detailed at the top of this privacy policy. We will delete such information from our files within a reasonable time.
